FEEL FIRST DAILY – TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the Feel First Daily mobile application and related services (collectively, the “App”), provided by Feel First, Live Free, LLC (“we,” “us,” or “our”).

By downloading, accessing, or using the App, you (“you” or “User”) agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Important: The App is a self-help and educational tool. It is not therapy, medical care, or a crisis service.

1. Emotional Wellbeing, Mental Health, and Safety

1.1 Purpose and Nature of the App

Feel First Daily is designed as a self-help and educational tool to support emotional awareness, reflection, and intentional personal choice. The App offers prompts, exercises, educational content, journaling features, and other tools (collectively, the “Content”) intended to help you notice, name, and navigate your emotional experience.

The App is intended for personal growth, emotional literacy, and general wellbeing. It is not intended to diagnose, treat, cure, or prevent any medical or mental health condition, nor is it intended to replace professional advice of any kind.

1.2 No Therapy, Counseling, or Medical Advice

The App and its Content are not therapy, counseling, psychiatry, psychology, medical care, or any other form of professional healthcare service.

You understand and agree that:

  • No information, prompts, reflections, exercises, or other Content available through the App should be considered medical, psychological, psychiatric, or other professional health advice.

  • The App does not provide clinical assessment or diagnosis.
  • The App does not provide individualized treatment recommendations.

You should not use the App as a substitute for:

  • Therapy or counseling with a licensed mental health professional,
  • Medical care or psychiatric care, or
  • Professional advice from a physician, psychologist, psychiatrist, therapist, counselor, or other qualified provider.

Always seek the advice of a qualified healthcare professional with any questions you may have regarding your mental or physical health. Never disregard professional advice or delay seeking it because of something you read, see, or experience within the App.

1.3 No Crisis or Emergency Services

The App is not designed or intended for use in emergencies or crisis situations of any kind. The App is not monitored in real time, and we do not provide crisis intervention, emergency response, or active monitoring of user content or behavior.

If you are experiencing, or believe you may be experiencing, any of the the following:

  • Thoughts of self-harm or suicide,

  • Thoughts of harming others,
  • An inability to keep yourself or others safe,
  • A medical or mental health emergency,

do not use the App.

Instead, you should immediately contact emergency services or crisis support in your area. For example:

  • In the United States, you can call or text 988 (Suicide & Crisis Lifeline) or call 911 or go to the nearest emergency room.
  • Outside the United States, contact your local emergency number or a local crisis hotline or go to the nearest hospital.

You understand and agree that the App is not a hotline, crisis center, or emergency service, and that we have no obligation to monitor your use of the App or to intervene in any situation.

1.4 No Professional Relationship

Your use of the App, including any Content you access or any information you provide, does not create any professional relationship between you and Feel First, Live Free, LLC, or any of its owners, employees, contractors, coaches, or affiliates.

In particular, your use of the App does not create a:

  • Therapist–client relationship,

  • Counselor–client relationship,
  • Physician–patient relationship,
  • Coach–client relationship, or
  • Any other professional or fiduciary relationship.

Any information or guidance provided through the App is general in nature and is not tailored or delivered as professional advice for your specific circumstances by a licensed professional.

1.5 Emotional Content, Triggers, and Personal Limits

The App is designed to help you “feel first” by bringing greater awareness to your emotional life. Some prompts, reflections, exercises, or Content may, by their nature, surface:

  • Uncomfortable or intense emotions,
  • Painful memories or experiences,
  • Sensitive or triggering material.

This is a normal possibility in emotional awareness work, but it can feel challenging or overwhelming at times. By using the App, you acknowledge and agree that:

  • You are responsible for choosing which exercises, prompts, and features you engage with.
  • You may stop using any exercise or the App at any time if you feel uncomfortable or overwhelmed.
  • If your emotional state becomes unmanageable or feels unsafe, you will stop using the App and seek support from a qualified professional or emergency services, as appropriate.

We do not and cannot guarantee that using the App will always feel comfortable, and we are not responsible for any distress you may experience in connection with your emotional process.

1.6 User Responsibility for Wellbeing and Decisions

You remain solely responsible for your own physical, emotional, and mental wellbeing and for the decisions you make in your life.

By using the App, you agree that:

  • You are responsible for monitoring your own mental and emotional state and determining whether using the App is appropriate for you at any given time.
  • You will seek professional support when needed, including but not limited to therapy, counseling, psychiatric care, medical care, or crisis services.
  • You will not use the App in place of professional care when such care is needed or recommended.
  • You are solely responsible for any decisions, actions, or inactions you take (or do not take) based on your use of the App or reliance on any Content.

We do not promise or guarantee any particular outcomes, results, or changes in your emotional state, relationships, health, career, or life circumstances from using the App.

1.7 Intended Users and Scope of Use

The App is intended for use by individuals who:

  • Are generally stable and capable of engaging in self-reflection,
  • Are generally stable and capable of engaging in self-reflection,
  • Are seeking greater emotional awareness, clarity, and intentional choice in everyday life.

The App is not designed to manage or treat:

  • Acute psychiatric conditions,
  • Severe depression or severe anxiety,
  • Psychosis, bipolar episodes, or other serious mental health crises,
  • Active trauma crises or complex trauma requiring specialized treatment,
  • Substance use disorders requiring medical supervision.

If you have, or believe you may have, any such condition, you should work directly with a qualified healthcare professional and not rely on the App as your primary means of support.

1.8 Sensitive Information and Privacy (High-Level Summary)

Using the App may involve recording deeply personal and sensitive information, including but not limited to:

  • Your emotional states,
  • Personal experiences, memories, and reflections,
  • Notes about your relationships, work, or health.

We recognize that this information is sensitive. A separate Privacy Policy explains in detail how we collect, use, store, and protect your information and what rights you may have regarding your data. That Privacy Policy is incorporated by reference into these Terms and forms part of your agreement with us.

By using the App, you:

  • Acknowledge that the transmission of data over the internet and storage of data cannot be guaranteed to be 100% secure.
  • Accept that you provide information at your own risk, while we use reasonable measures to protect it as described in our Privacy Policy.
  • Agree to review and understand our Privacy Policy before or while using the App, and to use the App only if you are comfortable with how your information will be handled.

1.9 Self-Harm and Safety Statement

We care about emotional wellbeing and personal freedom, and the App is intended to support you in cultivating greater emotional clarity and healthier choices. However, we cannot monitor, assess, or respond to individual risk in real time.

By using the App, you agree that:

  • You will not rely on the App as a safety mechanism if you are at risk of self-harm or harming others.

  • If you experience persistent thoughts of self-harm, suicide, or harming others, or if you feel unable to keep yourself safe, you will immediately seek in-person help from a qualified professional, emergency services, or crisis hotline.
  • You understand that we have no duty or ability to identify or respond to such risks through the App.

2. Eligibility and Accounts

2.1 Eligibility

You may use the App only if:

  • You are at least eighteen (18) years old (or the age of majority in your jurisdiction), and
  • You have the legal capacity to enter into a binding contract.

If you are using the App on behalf of another individual or entity, you represent and warrant that you are authorized to accept these Terms on their behalf and that all references to “you” in these Terms refer to both you and that individual or entity.

2.2 Account Registration

To access certain features of the App, you may be required to create an account and provide certain information (such as your name, email address, or login credentials).

You agree that:

  • All information you provide will be accurate, current, and complete; and
  • You will promptly update any information that becomes inaccurate or outdated.

We may refuse registration or terminate accounts at our discretion, consistent with applicable law.

2.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to:

  • Not share your password or account with any other person; and
  • Notify us immediately of any unauthorized use of your account or any other breach of security.

We are not liable for any loss or damage arising from your failure to safeguard your account or password.

3. License to Use the App

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Download and install a copy of the App on a mobile device you own or control; and
  • Access and use the App solely for your personal, non-commercial use, in accordance with these Terms.

3.2 Restrictions

You agree that you will not:

  • Copy, modify, or create derivative works of the App or any Content, except as expressly permitted by these Terms;
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code of the App, except to the extent that such restrictions are expressly prohibited by law;
  • Rent, lease, sell, resell, license, sublicense, distribute, or otherwise transfer the App or any Content to any third party;
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
  • Use the App for any illegal, harmful, or unauthorized purpose.

We reserve all rights in and to the App not expressly granted to you under these Terms.

4. User Content

4.1 Definition of User Content

User Content” means any information, text, notes, journal entries, reflections, data, or other materials that you enter, upload, submit, or otherwise make available through the App.

4.2 Ownership of User Content

As between you and us, you retain ownership of your User Content.

4.3 License to User Content

By using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, adapt, and process your User Content:

  • To operate, maintain, and improve the App and our services;
  • To provide features and functionality you request (such as saving entries, generating insights, or syncing across devices); and
  • To create aggregated, de-identified, or anonymized data that does not identify you personally, which we may use for analytics, research, product development, and other lawful business purposes.

We will handle your User Content and other personal data in accordance with our Privacy Policy.

4.4 Your Responsibility for User Content

You are solely responsible for your User Content and for ensuring that:

  • You have all necessary rights to submit it; and
  • It does not violate any law or the rights of any third party.

We are not obligated to monitor User Content but may remove or restrict access to User Content that we believe violates these Terms or applicable law.

5. Acceptable Use

You agree not to use the App to:

  • Violate any applicable law, regulation, or court order;
  • Infringe, misappropriate, or violate the intellectual property, privacy, or other rights of any person;
  • Upload, post, or transmit any User Content that is unlawful, threatening, abusive, harassing, defamatory, misleading, fraudulent, obscene, or otherwise objectionable;
  • Attempt to gain unauthorized access to any systems, networks, or data related to the App;
  • Interfere with or disrupt the operation of the App, including by transmitting viruses, malware, or other harmful code;
  • Use any automated means (such as bots, crawlers, or scrapers) to access or use the App in a manner not authorized by us;
  • Misrepresent your identity or affiliation with any person or entity.

We may investigate and take any appropriate legal action against violations of this Section, including suspension or termination of your access to the App.

6. Intellectual Property

6.1 Our Content and IP

The App, including all software, code, design, visual interfaces, text, graphics, logos, trademarks, names (including “Feel First Daily,” “Feel First, Live Free,” and “Feel First Framework”), compilations, and other materials provided by us (collectively, the “Content”), is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted in these Terms, you may not:

  • Copy, reproduce, distribute, publish, display, perform, or create derivative works from the Content; or
  • Use any of our trademarks, logos, or brand elements without our prior written permission.

6.2 Feedback

If you choose to submit feedback, suggestions, or ideas about the App or our services (“Feedback”), you agree that:

  • We may use the Feedback for any purpose, without restriction, compensation, or obligation to you; and
  • You waive any claim based on our use of the Feedback.

7. Third-Party Services and Links

The App may contain links to third-party websites, resources, or services, or may allow you to connect or integrate with third-party tools or platforms.

You acknowledge and agree that:

  • We do not control and are not responsible for any third-party services, content, products, or practices;
  • We make no representations or warranties regarding third-party services; and
  • Your use of third-party services is at your own risk and may be subject to additional terms and privacy policies from those third parties.

We are not liable for any loss or damage arising from your use of any third-party services or links accessed through the App.

8. Modifications to the App

We may, at any time and without prior notice:

  • Change, update, or discontinue any part of the App or its features; or
  • Introduce new features or impose limits on certain features.

We are not liable if any part of the App is unavailable at any time or for any period.

9. Changes to These Terms

We may update these Terms from time to time. When we do:

  • We will revise the “Last Updated” date at the top of the Terms; and
  • In some cases, we may provide additional notice (such as a notification in the App).

Unless otherwise required by law, the updated Terms will be effective when posted. Your continued use of the App after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App.

10. Disclaimers

To the fullest extent permitted by law:

  • The App and all Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
  • We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising out of course of dealing or usage of trade.
  • We do not warrant that the App will be uninterrupted, secure, or free from errors, viruses, or other harmful components.
  • We do not warrant or guarantee any particular outcomes, results, or improvements in your emotional state, mental health, relationships, or life circumstances arising from or related to your use of the App.

Nothing in these Terms is intended to exclude or limit any warranty that cannot be excluded or limited under applicable law.

11. Limitation of Liability

To the maximum extent permitted by law:

  • In no event shall we or our owners, directors, officers, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the App.
  • Our total aggregate liability for any and all claims arising out of or relating to these Terms or the App shall not exceed the greater of:
    • (a) the total amount you paid to us for use of the App (if any) in the twelve (12) months preceding the event giving rise to the claim; or
    • (b) [US $100] (or such other amount as may be specified by applicable law).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Feel First, Live Free, LLC and its owners, officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of or access to the App;
  • Your User Content;
  • Your violation of these Terms; or
  • Your violation of any rights of a third party or any applicable law.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with us in such defense.

13. Termination

13.1 Termination by You

You may stop using the App at any time and may delete your account if that option is available within the App or by contacting us as described below.

13.2 Termination or Suspension by Us

We may, in our sole discretion and to the extent permitted by law, suspend or terminate your access to the App at any time, with or without notice, including if we believe that:

  • You have violated these Terms;
  • Your use of the App poses a risk to us or others; or
  • We are required to do so by law or a governmental authority.

Upon termination, your right to use the App will cease immediately. Sections that by their nature should survive termination (including but not limited to payment obligations, intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms and any dispute arising out of or related to them or the App shall be governed by and construed in accordance with the laws of the State of [Insert State/Province], without regard to its conflict of laws principles.

14.2 Dispute Resolution; Venue

Subject to any mandatory arbitration or consumer protection laws:

  • Any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in [Insert County/City, State/Province], and
  • You and we consent to the personal jurisdiction and venue of such courts.

(If you intend to use arbitration and/or a class-action waiver, this section should be expanded by your attorney.)

15. App Store Terms (Apple App Store and Google Play)

If you download the App from the Apple App Store or Google Play Store, you acknowledge and agree that:

  • These Terms are between you and Feel First, Live Free, LLC, not with Apple or Google;
  • Apple and Google are not responsible for the App or its Content;
  • Apple and Google have no obligation to provide any maintenance or support services with respect to the App;
  • To the maximum extent permitted by law, Apple and Google will have no other warranty obligation whatsoever with respect to the App; and
  • Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.

You agree to comply with all applicable third-party terms of agreement when using the App (such as your wireless data service agreement).

16. Miscellaneous

  • Entire Agreement. These Terms, together with our Privacy Policy and any additional terms presented within the App, constitute the entire agreement between you and us regarding the App and supersede all prior or contemporaneous understandings.
  • Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
  • No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
  • Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice, to the extent permitted by law.
  • Headings. Section headings are for convenience only and have no legal or contractual effect.
